How Does the Massachusetts District Court Work?

The Massachusetts District Court is popularly known as the People’s Court. The court handles smaller violations of criminal and civil law, including housing, juvenile, mental health, and other types of cases. The Massachusetts District Court has jurisdiction over criminal cases which also extends to:

  • All felonies punishable by a sentence less than five years, and other specific felonies with greater penalties;
  • All misdemeanors; and 
  • All violations of town and city by-laws and ordinances

With jurisdiction over civil matters, the District Court hears cases where the damages are not likely to be more than $50,000, and small claims up to $7,000. The court provides a simple, informal, and inexpensive way of handling small claims with the Small Claims Guide and File. Here, persons can fill out the forms to file a small claim where the claim is $7,000 or less. The system generates filled-in forms that can be electronically filed in the proper court. Interested persons may also file a case in a District Court online, in-person, or by mail. The Massachusetts District Courts strive to administer justice promptly and effectively in line with the rule of law.

The District Court is responsible for issuing an Extreme Risk Protection Order (ERPO), also known as a red flag law. This is a judge’s order that directs the respondent to surrender their license to possess or carry a gun or any firearm. Respondents must surrender all shotguns, rifles, machine guns, stun guns, or ammunition in their possession or control. A family member or the police department in the city or town where the respondent lives can request an Extreme Risk Protection Order (ERPO). The individual requesting an ERPO is referred to as a petitioner and may be anyone who:

  • Is or was married to or engaged to the respondent
  • Is or was living in the same house as the respondent
  • Is or was related to the respondent by marriage or blood
  • Has or is having a child with the respondent
  • Is or has been in a committed dating relationship with the respondent

The District Court has an Appellate Division which hears appeals from specific civil actions, including money damages, mental health proceedings, and summary process cases. The court provides the following appeal options:

  • Expedited appeal
  • Appeal on the record of proceedings
  • Agreed statement of the case

    • Appeals in civil motor vehicle infraction cases;

    • Appeals in victim compensation actions under G. L. c. 258C and Dist./Mun. Cts. Supp.R. Civ. P. 151; 
    • Appeals in summary process’ bond orders under G. L. c. 239, §§ 5 and 6; 
    • Appeals from the denial of a fee waiver based on indigency under G. L. c. 261, § 27D); 
    • Appeals from the denial of a petition for relief from disqualification from owning a firearm based on a civil commitment under G. L. c. 123, §§ 35 and 36C[d]; 
    • Appeals from civil commitments under G. L. c. 123, § 35

    • Northern District (for Essex and Middlesex counties, and Chelsea District Court); 
    • Western District (for Berkshire, Franklin, Hampden, Hampshire, and Worcester counties); and

The Massachusetts District Court judges are appointed by the state Governor with approval from the judicial nominating commission and the Governor’s Council. The Commonwealth of Massachusetts judges do not have a fixed term and may remain in office until the compulsory retirement age of 70. The Massachusetts District Court judges must be under the age of 70 and should be citizens and residents of the United States and the Commonwealth of Massachusetts, respectively. In addition, all justices must be state bar members in good standing; and must have some years of legal experience and training.

The District Court provides online access to civil, criminal, small claims, summary process, and supplementary process records. Note that a search for most criminal cases can only be conducted by docket number. To search, the docket number must be inputted precisely how it appears.
